Fees and Payment Schedule

The client will pay a non-refundable booking deposit to confirm the services. The deposit will be applied to the remaining balance due on the invoice. Any additional fees accrued for add-ons and/or service adjustments will be reflected on the invoice and will be due before final images are released. All fees are subject to applicable taxes.

Rescheduling and Cancellation

If the client needs to reschedule any confirmed photoshoot dates, they will provide as much notice as possible. If rescheduling is requested by the client less than 48 hours prior to the confirmed photoshoot date, the final payment will be due in full. The payments may be applied to a new photoshoot date, provided it is within 6 weeks of the original confirmed date. If the client cancels the photography and/or other related services, the booking deposit is non-refundable. Full payment is due for any cancellations that occur by the client with less than 48 hours notice.

Photoshoot Direction and Punctuality

Hayley Rae Photography will direct the photoshoot as efficiently as possible to keep it running on time and ensure the pre-planned shot list is captured within the allotted time frame included in the services. If there are any delays caused by the client, we cannot guarantee all shots will be captured within the scheduled photoshoot time frame. Extended photoshoot time is subject to availability. If availability allows and the client would like to extend the photoshoot time, Hayley Rae Photography will bill the client for the additional photoshoot time. An updated invoice for additional fees will be provided to the client following the photoshoot. For on location photoshoots, we allot 15-20 minutes in addition to the photoshoot length for equipment load-in, set-up and brief location scouting.

Final Images

The final images will be selected by Hayley Rae Photography in editing, unless otherwise specified. If it is specified that the client will select their own images, an online proof gallery will be provided. Final images must be selected within 14 days of receiving the proof gallery. After 14 days, the Hayley Rae Photography will select the final images for editing on the client’s behalf. All final images are delivered digitally in high resolution. Additional edited images may be purchased for $25 each plus GST.

Photo Rights and Usage

Hayley Rae Photography reserves the right to publish photos for any business-related purposes, online and/or in print. All photos are the intellectual property of Hayley Rae Photography and, as such, no other person, business, or entity may claim credit for them. The client is granted the right to use the photos for their own personal and/or commercial purposes, except for the purpose of selling any actual photo(s) for profit, whether in digital or print format. The client may not under any circumstances offer, afford, or provide the photo(s) for any personal or commercial use where a third party directly benefits and/or profits from the use of the photos. Should the client use any photos to develop or create any type of product where the photo constitutes a significant portion of the composition and/or value of the product, Hayley Rae Photography will be entitled to a percentage and/or flat rate royalty fee if/when the product gross annual revenue exceeds $150,000. The royalty fee will be negotiated based on the individual circumstances and a variety of considerations, such as the type of product, distribution channels, the value the photo(s) afford the product, and other relevant factors deemed appropriate.

Limitation of Liability

Hayley Rae Photography, and/or any associates, will not be held liable to the client for damages, injuries, penalties, losses, or claims of any kind, whether they be direct, indirect, incidental, or consequential, arising out of or in connection with this agreement or any services provided. This does not affect any liability which cannot be excluded or limited under applicable law. Should Hayley Rae Photography be held to any inherent liability under law, this liability will be limited to the total value of the service fees for the service details and deliverables outlined in this agreement.

COVID-19 Guidelines and Waiver

Hayley Rae Photography is committed to providing a safe environment during all photoshoots. For in studio photoshoots, all contact surfaces are sanitized between appointments. Masks will be worn by staff and associates, and physical distance will be maintained during photoshoot(s) as much as possible. The client should not arrive early to the studio for a scheduled photoshoot. The client is required to conduct a COVID-19 health screening no more than 24 hours prior for all individuals who will attend the photoshoot(s) and prohibit anyone from attending who does not pass the health screening. Please refer to official government guidelines and resources for an adequate health screening. The client releases Hayley Rae Photography and its associates from any liability whatsoever related to any injury, discomfort, harm or other consequence that may occur to anyone involved in the photography services as a result of the COVID-19 virus.

Regretfully, the PS Collective Studio premise is not wheelchair accessible. There is a staircase from the main entrance to the studio space upstairs.
